COV Food Truck PAYGO
“pay-as-you-go” Event Agreement
This Agreement is made between COV Food Truck (Hereafter “COV Food Truck”) and [Name/Company Name] (Hereafter “Client”) for the provision of food services at the Client’s location and event as outlined below. NOTE: Your event date is not confirmed until your PAYGO AGREEMENT is submitted electronically using the form at the bottom of this page and your deposit has been accepted by COV Food Truck. The below form submission is your legal signature and upon submission this agreement is in full force.

Services Offered by COV Food Truck
COV Food Truck agrees to provide professional food services and menu previously agreed upon between COV Food Truck and the client during this pre scheduled event. Horvie’s Grill is responsible for all equipment, food, ice, condiments, flatware as needed, cups, drinks and other inventory as needed, including food preparation, food storage, and food deliver to client’s guests as well an electronic point-of-sale systems for accurate tracking of customer payments.
Payment & Compensation Structure
Guests/Customers will purchase and pay for food with COV Food Truck directly for their food choices at prices set by COV Food Truck (or a mutually agreed-upon price). The Host will not collect any payments from customers on behalf of Horvies Grill.
Minimum Income “pay-as-you-go” (Retainer Deposit)
The Client guarantees that COV Food Truck will earn a minimum income of One Thousand Dollars ($1000.00) for their services at our event. This amount is paid as a deposit/retainer to secure Horvie’s Grill services for your time and date.
(a) Deposit Payment:
The Client will pay the COV Food Truck a deposit of $1000.00 upon the signing of this Agreement.
(b) Income Reconciliation:
A the end of the event, or another date agreed on by both parties, COV Food Truck shall provide the Client with a detailed and verifiable report of their total gross income generated directly from customer payments at the event via POS system readout
(c) Refund/Forfeiture Clause
If the COV Food Truck total earned income is less than $1000.00: COV Food Truck shall keep the full $1000.00 deposit as their guaranteed minimum income for this event, no further payment is due from the Client. If and when COV Food Truck total earned income is $1000.00 or more: COV Food Truck shall refund the full $1000.00 deposit back to the Client within [Number, e.g., 5] business days of the income reconciliation.
Sales Taxes:
COV Food Truck is an independent contractor and is solely responsible for collecting, reporting, and paying all applicable local, state, and federal sales taxes (including income tax) on all income earned, including the guaranteed minimum payment if retained. The Client is not responsible for any taxes on services provided by COV Food Truck.
The Client agrees to inform all attendees that COV Food Truck will be present and open for business at the event.
COV Food Truck Liability
COV Food Truck shall not be liable for any claims, damages, or losses arising from the event, the talent, or any customer interactions. Horvie’s Grill is a fully licensed and insured Horry County business.
Cancellation Policy
Either party may cancel in writing. If the Client cancels, the deposit is 100% forfeited. If COV Food Truck cancels, the deposit will promptly be refunded back to the client.
Governing Law
This agreement and COV Food Truck is governed by all laws of the State of South Carolina.
